Transparency 11: Cristina Avendaño Leaves and Margarita Arboix comes back.
We should congratulate for the dismissal of Cristina Avendaño as General Director of the Spanish Drug Agency.
Last 08th November in the “ Transparency” blog, we denunciated that the General Director of the Spanish Drug Agency, appeared also referenced as the contact person in the Pharmacology Service of the Autonomous University of Madrid, and , paradoxically one of the projects they offer is the “Scientific, technical and regulatory assessment in clinical development of drugs for human use”.
Without publication in BOE (Official Spanish Newsletter: were all official regulatory affairs must be published before enter into force), as neither was her nomination, the 2nd December 2010 her destitution is communicated through a personal communication of Jose Martinez, according to our information sources.
On the other hand, Margarita Arboix has been named in BOE November 16th 2010, as General Director of Agricola and Breeding Resources of the Ministry of Environment, Rural and Marine media (ancient Ministry of Agriculture, Fishery and feeding)
The Science Philosophers say that deduction science is to discover what is behind the appearances. This is why we should answer: what is there behind the simultaneous destitution of Cristina Avendaño and the designation of Margarita Arboix?
Must be reminded that both have been showed in the Transparency blog for offering , through University services directed by themselves, services related with their regulatory position in The Spanish Drug Agency (please see blog 7 of September 28th and blog 10 from November 8th).
We can think about several questions to reveal the truth:
a) Are the changes of the responsible in the Ministry of Health and in the Ministry of Environment collateral effects?
b) Are effects of the clear incompatibility of being General Director and offering services, the destitution of Cristina Avendaño and a long period of 4 years from the destitution of Margarita Arboix, because of the small public memory?
c) Is this a trade- off of General Directions?
Although there are other questions, the third one has an special interest, specially if we related it with the questions in the blog dated November 8th. The questions 3 and 5 of this blog were:
– Is it casual that the non-published destitution of Margarita Arboix, was followed by the non- published designation of Cristina Avendaño, and that both were offering their assessment in regulatory affairs, related with their public position?
– How many money did they raise through these lobbies, and to which finalities the rich benefits were used for?
The first question could be reformulated right now: Is it casual the non- published destitution of Cristina Avendaño, December 2nd, as General Director of the Spanish Drug Agency, was preceeded in November 17th the designation of Margarita Arboix as General Director of Agricole and Breeding Resources of the Ministry of Environment, Rural and Marine media, ancient General Subdirector of Drugs in 2006, dismissed just before the arrival of Cristina Avendaño to the Drug Agency?
In our blogs 7 of September 28th, and 10 of November 8th, we informed that both, Margarita Arboix and Cristina Avendaño, one after the other, act under the same pattern, matching their Regulatory charge with the offering of their services to overcome the regulations that themselves should approve. Nowadays, none of them is in the Spanish Drug Agency, but casually Margarita Arboix reappears in nearly dates as General Director of Agricola and Breeding Resources of the Ministry of Environment, Rural and Marine media. For this, the second question can be reformulated now as : is this trade- off of General Directions an appearance to maintain the lobbies influence in the Public Administration, and where the funds were or will be destined?
As the designation and the removals are not published, and in the appointment of the new General Director there is no explanation of Margarita Arboix’ s merits in the public administration to achieve this designation. The reasons of this designations and removals are full of secrets, however, have the responsible politicians though that this secret attitudes will make them responsible for the acts of their designated as the acts from their own hand?
We can advance that there are complaints in several Litigation Divisions of the National Audience and that there is a nervous attitude in some instances due to the failure or the partial observance of cases from the Spanish Drug Agency.
